Ok, more free legal advice (Civil rts lawyer in el lay, 28 yrs). Federal law prohibits discrimination against certain protected classes, ie race, religion, gender, etc.) State law varies (gym located in unknown state). In California, the Unruh Civil Rights Act (Civil Code, Sec. 51, et seq) protects the same general classes, but is a bit broader than federal law, and specifically prohibits threats and violence and provides for certain remedies. The question here is factual. What did you do? They claim one thing and you claim another. In either instance, the law does not seem to fit your case because you don't claim discrimination against you as a member of a protected class. Arbitrariness is very iffy and murky, and decided on its facts - the ad linked to suggests oddball stuff like "a lazy eye." That is not helpful at all in this case because they claim some sort of inappropriate behavior on your part. Hence, you probably don't have a case, ignoring the practical aspects of not being able to hire a lawyer or obtain one on a contingency basis. I suggest asking someone prominent in the community that both of you respect to mediate. Have them initiate the calls and follow the advice already given, be humble and promise to behave. Got to get back to work.
