In reply to: It is your sole responsibility to understand the risk incurred Just a suggestion for next time: You need to say "it is solely your responsibility." Saying "it is your sole responsibility" isn't saying anything; it only means that they have no other responsibilities in life -leaving you to share in the responsibility. You should make it clear that the only responsibility for the risk belongs to them, but not that the only responsibility they have is to accept the risk of using your gear. If you are going to get technical, do it right. If you use a technical-sounding disclaimer when selling stuff on the internet, it makes it clear that you weree fully aware of the legal risks and liabilities involved, which in turn means that if you end up in court you can’t play the ignorant innocent climbing bum who never took into account the possible ramifications; you will be treated as accepting legal risk as part of your sale. Thus, you might get screwed if your jargon isn’t perfectly formed and ultimately be held liable. Eric

In reply to: It is your sole responsibility to understand the risk incurred Here’s just a quick totally lame comment from a guy who is bored sitting at work in the dark corner of the law firm late at night… You need to say "it is solely your responsibility." Saying "it is your sole responsibility" isn't saying anything; it only means that they have no other responsibilities in life -leaving you to share in the responsibility. You should make it clear that the only responsibility for the risk belongs to them, but not that the only responsibility they have is to accept the risk of using your gear. If someone gets hurt using your gear and files a lawsuit against you, a tiny mistake like this could mean total ruin. If you are going to get technical, you have to do it right. If you use a technical-sounding disclaimer when selling stuff on the internet, it makes it clear that you were fully aware of the legal risks and liabilities involved when you posted your add; which in turn means that if you end up in court you can’t play the ignorant climbing bum who never took into account possible ramifications. You will probably be treated as having accepted legal risk as part of your sale. This means that you will be more likely to be held to a much higher standard and might get crapped on for having less than perfect jargon when presenting your product (and the risks you wanted to transfer as part of the sale). Make it “attorney-tight” or leave the fluff out. Eric

I can't seem to get any pictures sent...I'm on dial up and it is taking ages. I'm going to try and get them all posted online somewhere come Monday or Tuesday when I can get to a computer with a faster connection. So if your a stickler for seeing the pics please be patient. If not just PM me with what you want. - Ethan BTW - I'm accepted both Cashier's Checks and Money Order's. However if you must...you can send a Personal Check, however you'll have to wait till it clears. That said...I strongly prefer you don't (send a Personal Check) for obvious reasons.

I managed to put together a website: http://www.geocities.com/brodey315/ for the pics...it seems to work off and on. I think I got back to everyone who responded....if you sent me an email or PM and I haven't responded, send me another PM and bitch. I've been a bit overwhelmed with the amount of responses. There is still a lot of gear left...PM me if your interested. Just be sure to give me your email so I can send you pictures when I can (I have feeling that website is not going to the trick). -Ethan

In reply to: PM sent - set offsets (0-11)/ BD hooks The goods arrived, and in superb condition. When he says "like new" he means it. If anyone has been mulling about buying any of this stuff, go for it. I figured I'd just toss my recomendation out there... bump.
