You risk getting a citation for Class 1 trespassing if caught. The officers have explained that the Railroad has access 30' on both sides of the tracks. This encompasses all of the crag. There are new trespassing signs erected at the RR crossing.

The Railroad is pressing hard for enforcement. Contact the Lake Oswego PD if you have questions.

OK folks...the courts fined me $267 and ordered me to work 50 hours community service. I could pay $10 for each hour but I chose to do work instead. They made me get council as well. $500. I still dont know why they couldn't just have given me the penalty without this guy...

So...someone needs to get the clips off of the wall so as to prevent any other "victim" from attempting to climb here.

... So, you saw the sign, took a picture, and yet still made a concious decision to climb at this spot?

Doesn't seem like it was a responsible thing to do.

(I'll give you the benefit of the doubt and assume you went back to take the picture after this incident; or on the way out after you were cited.)

I assume it's a railroad right of way. If so, who actually owns the land? Is the railroad behind the posting, or the landowner?

Yep, though it's a more resounding blow when you can beat them at their own game. I've seen one similar situation (where the cliff is probably closer to the tracks) and the railroad lost. Makes a hell of a racket when the train goes by and the garbage loads stink like hell.

There are properties on both sides of the tracks. The officer says that they have control of the property 30' out on both sides of the tracks.

The sad thing here is that this has been bolted for decades. and only now do they enforce this rule. The train comes by only a few times a month. I've had to stop at the crossing maybe 3 times in the 7 years I've lived here and each stop was at 2am.

I cant afford to put up a battle with the city. They are only the enforcement agency. Although I would be interested to know how many dog walkers, if any, have been cited for the same "crime".

Yeah.... That is true. Folks have been climbing there for decades. The signs went up in Feb. I went to watch folks climb there all spring and summer. I finally started in late June....

If the railroad wants to keep folks off, perhaps they should allow someone to take the bolts off. It would keep most people off. As of last month, the bolts are still there.

Sounds like you should contact the Access Fund about some legal assistance or at least advice. Those railroad boys are still bullies that will try to keep you out by using the local law enforcement as their unwitting pawns (evil laugh) even if they're not legally in the right. It doesn't seem that a right of way should allow the railroad to deny usage of unique aspects of the property (the cliff, that isn't theirs) along the right of way.

The Railroads are ALL Powerful, and can pretty much do what they want within their righ of ways. Do not have to provide access, and infact they fight against any trespass or crossing. Best bet is keep lowkey and don't draw attention to the crag, but sounds like to late.

wow. Just took two of my friends climbing there around 2 months ago. We chose to ignore the sign and climb anyway. No one bothered us. Its not that great of climbing but it sure chaps my a** on principle.

I'm sure like all of us, you enjoy the benefit of low cost goods that RR's transport. 100 years ago they did blah blah is not a valid argument. Railroads serve a useful purpose, and you have no more right to trespass on their property than I have to use your front yard for refuse disposal. If you don't agree with the concept of ownership, then send me your bank account info. Otherwise, you're just hypocritical and immature.

The reality is, in our litigious society, if some moron got hurt there they'd sue the railroad. What, are they supposed to let climbers trespass and then "hope" they don't get sued someday? I'm sure the lawyer that recommended that strategy to them would find themselves unemployed. That's the sad fact. Ideally, you could sign a waiver and climb there. But what's the RR's incentive to do that?

Exactly what railroad uses those tracks? Is it a customer / industrial spur or a general line? It might be worth figuring out, because if it's a general line that means you're likely talking the same folks who manage the track out at Beacon and you piss them off in LO and you've essentially opened the door to them looking at climbing at Beacon - where they have power and leverage - with a bit more jaundiced eye than they already do. Just a thought anyway...

Edit: just checked google maps - if this track is the green one then I wouldn't worry too much about it. If it's the red one then you might want to at least be think about the law of unintended consequences and picking your battles...
