Hi Gang,

THIS FILM, that follows every pitch of Mescalito on El Cap, is a lot of fun and worth getting. Unfortunately, I've only seen the first of the 2 DVD set. The second was damaged in transit. It's amazing to see all that work!!! Jug, jug, jug, jug, jug, jug, jug. Beautiful geometry of the stone. I could recognize the features I was seeing as I following along on my Chris Mac topo. This is very much a "home video." But in a lot of ways its more interesting than the other "professional" films I've seen. For one thing, it's the only one that really depicts the scale, the immense scale of El Cap. It shows how steep and unbroken it is. It shows the exposure. My first reaction is one of terror!

Cameo appearance by PTPP. Dr. Piton is on the North American Wall I'm guessing at Calaveras ledge (assuming I'm reading my topo correctly).

Highly recommended.

WTF!?!

I never gave anyone permission to put me in a DVD, especially not one they are going to sell!

I have not seen the photos/footage, whatever it is.

Kim - I am having trouble getting your link to work...could you please post up a web address or contact information for the people who made this video?

I don't think its right to use photos of a person without their permission in something like this...

IMHO it would been nice to ask Kate and Pete if it was ok. It's not like they are hard to get ahold of.

I just realized that this is Heinz W, or Henry, a German dude who spends his summers in Yosemite.

I had trouble with this guy showing up at the base of Mescalito, and looking through my stuff when he didin't realize that I was watching him from the trees at the base. In fact, he showed up at the base twice when I was trying to solo a route last year. I had to ask him to leave, as he mocked me during the start of the climb and was creeping me out.

I am not happy about this and do not support his distribution of photos of me to a broad audiance without my permission!!!!

I saw him in C4 and spoke to him after his climb of Mescalito, and he never mentioned that he hand filmed or photographed me!!!! His partner also has my contact information. His party did take pictures while on route but never mentioned that they were for any specific thing.

He has my email contact information through RC.com and has contacted me in the past. He NEVER contacted me regarding using me in this project!

This person does NOT have my permission to distribute pictures of me!

I have contacted him via PM and Email asking to be removed from the DVD. I don't mean to be a jerk, but a guy who makes me uncomfortable is distributing pictures of me without my permission!

To All:

This "Gentleman" will not edit his DVD and has no concern over secretly using video of another climber to further his efforts, stating that it is "not illegal".

Henry, there are many things that are "not illegal" which you would find incredibly unpleasant. Thats where decency and consideration come in!

Out of respect for one another in this community where we enjoy our sport out of doors, most have the decency to ask to use such material when we have CLEAR OPPORTUNITY to do so.

Henry, please stay away from me in Yosemite next year!

You can't CONTROL how your image will be used when you're climbing in the PUBLIC DOMAIN--i.e., on El Capitan. In a court of law, filming you on a wall is not considered an invasion of privacy and you'd be hard pressed to require the Rude Kraut to ask for your permission. The Rude Kraut would incur too much expense to simply edit you out of what likely is just a garage production anyhow.

Perhaps there's a golden lining: You have--or can get--actual footage of yourself on a wall, something that might be valuble in 20 years, at least to you. I did a stack of wallls and because I rarely if ever brought a camera (didn't own one), I only have a few shots.

Much as we try we can't always do things strictly on our own terms. Not a pleasnat thought, but true nevertheless.

Kate - don't apologize, although it may not be illegal, it's still good manners to at least mention that he would be producing a DVD with your image for distribution. It's too bad that you get bad vibes from him, otherwise you may have been happy to show up on something like that. As vivalargo said, it may be your only cameo on an el cap production!

If he is rude, as you say, I'll stay away from this purchase......unless convinced otherwise.

I agree, he didn't do anything illegal and I think you are over reacting, so I won't be buying his product. I will also forward this thread to all climbers on my Email book.

While I cannot attest to the legality of this vid's distribution, I do know that Kate is NOT a public figure. She was in a relatively public place, but she is a private figure.

This proves that Henry can be a good guy and help people feel comfortable, even when not legally required to do so. Thank you, Henry.

I know those guys were having fun on that climb, as I was in communication with them the whole time. And that's the whole point, as I recall.

Kim, did they have video of the storms? That would be rad.

Well, everyone has different opinions on people, and it isn't for me to judge whether or not he's a good guy beyond this instance.

However, in this instance, he proved he could compromise, which I appreciate. (Which is more than I can say for me, actually) He's probably not one of my favorite folks, and I'm Certainly not one of his, but that shouldn't mean much to anyone else, really.

We'll probably have to schedlue a nice Cat Fight in C4 next September...I'm free Sept 4 thru Sept 7th...the video will be for sale on my website...just kidding!

Our opinions about ourself are probably the most important--and likely to be the most limiting. "Private" and "public" are just self-images, and when we move outside of our own self-labels it's uncomfortable but exciting if we can steer clear of the knee-jerk reaction to place some faux objectivity on our self image ("I really am like this") or stack virtue on top of a certain choosen style, private, public, or whatever. Those are just psychological games to make sure we never stray far from our self image, mistaken as we are that this is who we are.

For insatnce, I tend to be loud, over the top energy and so forth. It's great for me to practice being invisible in a crowd, never calling attention to myself. For a "private" person, leaping out of the shadows with a "hear-me-roar" tude can be a remarkable experience. A lot of our bullshit jumps out when we move outside our self images. Probably the biggest bullshit part is the sub-personality that says you're faking it when you're not toeing the line with your self image. In fact you're simply testing yur dynamic range.

Now, where can I buy the video with Kate in it?

That’s a very good point. It always pains me to watch people miss out on opportunities because it’s not “my type of activity” or “my sorta woman”. If you find one flavor and never deviate from that simply because “that’s your flavor” and it would be “un-you” to do otherwise you can miss out on a lot.

well dudes ....

nice to see all the emotionally involved people out there talking and contributing to this matter.
So here is my point of view to all this:

1) it is to differentiate between a personal wish and a enforcable regulation
2) what Kate wanted is legally regarded as a wish
3) the truth is: Kate was on New Dawn going for Tribal Rite !
4) this truth will never go away even if the publisher of the truth is killed
5) free press is one of the highest goods in US, protected by the constitution
6) privacy is not given in public - no person need to be asked for beeing recorded
7) the video is a documentation of a climb
8) the video is NOT business at all (only refund for shipping was asked for)
have a close look at every single word used on the post !
9) the video has been announced as AVAILABLE
10) no thing and/or no person on this vidoe shows any signs of commerce
11) if the objections of all the commentators could be enforced, any politician or any other person of public interest could avoid any documentary pictures or reports about himself when not wanted (a lot love to apply this right when it does not fit them)
12) I did not give in - I still stick to press freedom and to the TRUTH !
13) I re-edited the video in order to fit on 1 dvd - so I took away those scenes of Kate which are of secondary importance to the documentation
14) the sole purpose of the video was to present the climbing community what is bigwalling about in motion pictures and for bigwallers to re-experience or re-live their past deeds
15) I feel not doing wrong and if someone out there is free of any defect and has already gained perfection (universal wisdom, compassion, immortality etc. ) so he might throw the first stone ....
16) possible conclusion: the present evolutionary state of the US shows arrogance, selfishness and very efficient materialism with strong tendencies to brutality and revenge - and they love their many dogmas ..
