Im taking webpage design in school and a biggie here is not to use copyrighted pics. Am I allowed to post pictures found on this website on my website, if I give credit to rc.com and name the person in the photo and tell who photographer is.

"TERMS AND CONDITIONS Rockclimbing.com provides this great service to the climbing community of storing hundreds of photographs of climbing areas and climbers all over the world. In return for this free service, the only thing we ask is that we retain the rights to use these photographs in any way including but not limited to the following: reselling, modifying, using for advertisements, and distributing. We promise to give you credit throughout our website as long as you tell us who you are. We also give no implied or expressed warranty of keeping this website and your submitted photographs live on the Internet. However, we will try very hard to keep everything running smoothly. By submitting a photograph below, you promise to this agreement. If you would like to negotiate other terms, you may email the owner of this website to discuss other arrangements. If you do not own the rights to the photo you are submitting then you most notify the owner before submitting it. If you do not and the rightful owner sues for damages, then you may be prosecuted. "

RockJock- Copyright protection is automatic for any piece of original art work. The person who owns the art work does not have to invoke these right in any way. They exist as soon as the picture is taken. However, copyright protection does not usually apply to academic pursuits. That is how your teacher can get away with photocopying pages out of books etc. As long as you are not trying to benefit from the use of the pictures or claiming them as your own then you can use them in your studies. However, you teacher may have more arbitrary rules about what you are allowed to do. As long as you credit the person who took the picture you should be ok.

Hrm.. Having read the Terms and Conditions - it seems that by putting your picture(s) on rc.com, you allow rc.com to use your picture(s) as they wish. However, you are not signing over your Copyright on the images - if this was the case, I'd have to ask respectfully that they be removed. (Assuming Trevor & Co. would honor such a request) However, if a third party (i.e. not affilliated with rc.com) wants to use your picture(s), they will have to ask you (the photographer) for permission.. -d.

hmmmm, I sure don't like that RC.com can resell or use our pics for advertising....would we get money for it if they sold it??I am not sure that the site would prevail in a court battle regarding rights there....maybe that should be reworded so that RC.com doesn't get themselves in trouble by selling a pic or using it for advertising outside this site....you sell pics to users for posters say and I'm sure you will have a pissed photographer if he doesn't get a piece of the pie...any thought admin????

If you submit a photo, you agree to the terms and conditions. It's really that simple. And I highly doubt rockclimbing.com would sell a photo for enough money that would warrent a lawsuit or that anyone who came here would be that shallow and pathetic.
